THE FOLLOWING TERMS AND CONDITIONS ("TERMS") APPLY TO YOUR USE OF AND ACCESS TO THIS WEBSITE AND THE GALLERIES HOSTED VIA PIXIESET, WHICH ARE OWNED AND OPERATED BY Jewelz Photo and its associated entities Jewelz Sports Photography and Heavens Jewel Photography ("PHOTOGRAPHER", "WE," "US," OR "OUR"). THESE TERMS REPRESENT A LEGALLY BINDING AGREEMENT BETWEEN YOU ("YOU", "CLIENT", "USER") AND PHOTOGRAPHER REGARDING YOUR USE OF THE WEBSITE, AND SERVICES PROVIDED. BY ACCESSING OR USING THIS WEBSITE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS.

1. ELIGIBILITY

You may use this website and access galleries if you are at least 18 years old. If you are under 18, you may use the website with the express consent of a parent or legal guardian. And such consent holds no legal responsibilities with PHOTOGRAPHER should any need for such occur.

2. SERVICES

2.1 PHOTOGRAPHY SERVICES

We offer professional photography services, including but not limited to in-action during sports or anything in relations to or similar, engagements, weddings, maternity, and various portraits styles. All services are subject to individual agreements.

2.2 CLIENT GALLERIES ACCESS

PHOTOGRAPHER provides access to public, private, and sometimes password-protected galleries for clients via Pixieset. These galleries allow clients to view, download, and/or purchase digital or printed images.

2.3 GALLARIE PRINTS AND DIGITAL PRODUCTS

Monitor color display calibrations differ, therefore, the colors in photo prints, books, images and media may be slightly different than what is viewed online.

Should cropping be needed, Customer agrees to review every photo and album prior to it being sent to the lab and will preserve the photo to represent the original digital display as much as technology allows. Customer holds no responsibility to Jewelz Photo and its associated entities, for images not held to the liking of Customer

3. ACCOUNT ACCESS AND SECURITY

Public viewed galleries are not protected by password links and You understand photos viewed by these public events are accessible to anyone. You hold no legal action with PHOTOGRAPHER if images are displayed in anyway not to Your liking. If galleries are sent privately, You will receive a unique gallery link and possibly a password to access your images. You are responsible for maintaining the confidentiality of your credentials and preventing unauthorized access. Do not share your gallery link or password with unauthorized individuals.

4. TERMS OF SALE, PAYMENTS AND REFUNDS

4.1 TERMS OF SALE

These Terms of Sale is applicable to your purchase of any prints, digital products and other products through Photographer's online store (powered by Pixieset) and fulfilled by our Partner Print Vendor, In the event of any conflict between these Terms of Sale and the other provisions of the Terms, these terms of sale will prevail. These Terms of Sale may not be altered or amended in any way, and all sales are expressly conditioned upon your agreement to these Terms of Sale.

4.2 PAYMENTS

Payments for digital downloads, prints, and other products are due at the time of purchase. We accept major credit cards and payment platforms (e.g., PayPal).

4.3 REFUNDS

All sales for digital products, including downloads and prints, are final. Once delivered, no refunds will be provided.

5. INTELLECTUAL PROPERTY AND USAGE RIGHTS

5.1 OWNERSHIP

All photographs remain the exclusive property of PHOTOGRAPHER even after purchase or delivery.

5.2 LICENSE TO USE

Clients are granted a limited, non-exclusive, and non-transferable license to use their images for personal, non-commercial purposes, including:

  • Sharing on personal social media accounts.

  • Printing for personal use.

5.3 RESTRICTIONS

Clients may NOT:

  • Edit, alter, or manipulate images without written permission.

  • Use images for commercial purposes, including resale or distribution.

  • Remove watermarks or credit markings.

5.4 CREDIT ATTRIBUTION

When posting images online, you agree to provide proper credit to PHOTOGRAPHER by tagging or referencing @Jewelz Sports Photography OR @Heavns Jewel Photography

6. LIMITATION OF LIABILITY

We are not responsible for:

  • Service interruptions or technical issues on the Pixieset platform beyond our control.

  • Loss, deletion, or corruption of files after they have been delivered.

  • Unauthorized access to client galleries resulting from your failure to protect passwords.

Galleries may be disabled or removed after a set time frame, as stated in this service agreement.

7. PRIVACY POLICY

We value your privacy. Pixieset and the PHOToGRAPHER collects and uses personal information to provide serves. This incormation is generally kept confidential and only used for service-related purposes.

8. TERMINATION OF ACCESS

PHOTOGRAPHER reserves the right to disable or delete galleries after 3 months unless an extended agreement has been reached. between PHOTOGRAPHER and CLIENT. PHOOGRAPHER can hold its galleries online for as long as PHOTOGRAPHER deems fit.

9. DISPUTE RESOLUTION

Any disputes or claims arising from these Terms will be resolved via binding arbitration and governed by the laws of the State of Oregon

10. MODIFICATION OF TERMS

We reserve the right to update or change these Terms at any time. Changes will take effect immediately upon posting, and the "Last Updated" date above will reflect the changes. Continued use of the website constitutes your agreement to the updated Terms.

BY ACCESSING THIS WEBSITE OR ANY GALLERY ASSOCIATED WITH PHOTOGRAPHER, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO THESE TERMS & CONDITIONS.

You are responsible for any taxes that you are obligated to pay or the photographer may collect from you with regards to the purchase of the products. You are also responsible for the taxes or fees in the event they are later determined to be payable on the sale. Such taxes may be added to the purchase price and reflect on your invoice or receipt.

You are responsible for paying all shipping charges applied to the order, the charges will be shown on the checkout page and it is subject to verification and to correction or change. All orders are shipping FOB shipping point, which means the title of the goods passes to you upon shipment. Pixieset Print Vendors will use reasonable efforts to ship all orders within the estimated delivery time applicable to the method of shipping you have chosen at time of order. Pixieset or the Print Vendors reserve the right to substitute another shipping vendor to deliver the order. Pixieset is not responsible for any delays in shipping and other costs that may arise from the delay.

All prints and other products purchased are non-refundable and non-exchangeable. If the prints or products you received is physically defective, you are responsible for contacting the photographer within thirty (30) days of your receipt of the products, and work out the necessary arrangements for either a refund or a replacement. The foregoing right to return any order within thirty (30) days to your photographer is your sole and exclusive remedy, and Pixieset, and Jewelz Photo and its associated entities expressly disclaims and excludes all warranties, expressed or implied, regarding the purchase of any products. Pixieset will do its best to present accurate information in the product options however Pixieset or Jewelz Photo and its entities do not warrant that the product description, photos and pricing are accurate, complete, reliable, current or error-free. All size dimensions are approximate, we make reasonable efforts to accurate display all details of the product offerings, including the applicable color, and the applicable crop (in the case that the product needs cropping to fit the selected sizes), please note that the actual color or crop you will see might be different. Pixieset Print Vendors reserve the right to format manipulate or modify the image as may be required to satisfy a particular order. In the event of an error, we reserve the right to correct such error and charge the correct price or cancel your order.  You must agree to the digital image license set forth by the photographer prior to purchasing a digital download product.  You acknowledge that Pixieset and Jewelz Photo and its entities provides no warranties for any digital product license and your are entering into the license agreement with the photographer.  Pixieset is not responsible for enforcing the agreement nor resolving any disputes Jewelz Photo and its entities.
